What Happened

New York Attorney General Letitia James released the hospital financial aid guidance on August 20, 2026.

The timing follows a July 1 reduction in New York’s Essential Plan income limit from 250% to 200% of the federal poverty level. The attorney general said the change caused an estimated 450,000 New Yorkers to lose zero-premium Essential Plan coverage.

The underlying protection is not new. It comes from New York Public Health Law section 2807-k, which requires hospitals to maintain financial aid policies for eligible uninsured and underinsured patients.

Who Qualifies for New York Hospital Financial Aid

Eligibility depends on household income and insurance status. The 2026 federal poverty guideline for a four-person household is $33,000, making 200% equal to $66,000 and 400% equal to $132,000. Those figures come from the 2026 HHS poverty guidelines.

The income figure does not guarantee approval or a particular discount. Hospitals may offer larger discounts or help households earning more than 400% of the poverty level.

Insured Patients May Also Qualify

New York hospital financial aid is not limited to uninsured patients. The attorney general’s detailed consumer guidance says an insured patient may qualify after using all available benefits.

A patient may also be considered underinsured when medical expenses actually paid during the prior year exceed 10% of pre-tax household income. Deductibles, copays, coinsurance and deposits can count. Monthly insurance premiums do not count toward that calculation.

What the $132,000 Threshold Does Not Cover

The law applies to hospitals, not every health care provider. A separate bill from an independent physician, ambulance company or laboratory may follow different assistance rules.

Emergency care is covered for eligible New Yorkers who meet the financial and insurance conditions. For non-emergency medically necessary care, a hospital may limit mandatory assistance to eligible patients living in its primary service area. Help with copays and deductibles can also depend on hospital policy and proof that the patient cannot pay.

How to Apply for New York Hospital Financial Aid

Every New York hospital must use the state’s standard application. Patients can obtain the 2026 hospital financial assistance application from the Department of Health or request it from the hospital’s billing office.

An application may be submitted from the date of service through the billing and collection process. After receiving a completed application, the hospital must generally issue a written decision within 30 days and explain how to appeal a denial or disputed award.

A hospital cannot send the bill to a debt collector while the application is under review. It also generally cannot send the bill to collection or start a civil action for at least 180 days after the first post-service bill.

Eligible patients must be offered an installment plan. Monthly payments cannot exceed 5% of gross monthly income, and annual interest cannot exceed 2%. A hospital cannot use immigration status as an eligibility factor or ask about assets such as a house or car. Applying does not count as a public benefit, and hospitals cannot report applicants to immigration authorities.

An unpaid bill also cannot be used to deny emergency or medically necessary hospital care.

What Patients Should Do Now

  1. Ask the hospital’s financial assistance or billing office for the current application and written policy.
  2. Gather the hospital bill, insurance explanation of benefits, proof of household size and income records.
  3. For underinsured eligibility, save proof of medical costs actually paid during the previous 12 months.
  4. Submit the application through a traceable method and keep copies and submission dates.
  5. Request the decision in writing and use the stated appeal process if the hospital denies assistance.
  6. Do not place the bill on a general-purpose credit card before checking hospital aid or a protected payment plan.
